Please read these Terms and Conditions carefully before enrolment. You must not complete and sign your Actors Co. registration form unless you agree with these Terms and Conditions.
I acknowledge that I have read the Actors Co. enrolment form, including the Terms & Conditions and agree to fulfill my obligations outlined therein & unconditionally enter into this legally binding document acceptance of the proposed terms and conditions.
I agree/understand that:
a) I agree not to film or record any aspect of the class(es)/cours(es) in which I participate, including the online training conducted using online technology (such as Zoom or WhatsApp) which permits recording b) I agree to comply with the Intellectual Property clauses as set out herein c) I understand that if The Actors Co. determines that I have not complied with its Terms & Conditions, Rules & Guidelines, policies & procedures then I may be excluded from classes or have my enrolment rescinded d) I confirm that information I have provided on the Actors Co. enrolment form is accurate Parental/Guardian Consent (Under 18 Years) If enrolling student is under 18 at the time of filling out this form, a parent or guardian acknowledges that they have read this enrolment form and agrees:
a) I authorise the enrolling student to participate in classes at The Actors Co. and that I will be liable for payment off all tuition fees b) I have explained to the student their obligations under the Terms & Conditions c) The student has acknowledged that he/she/they/them has understood d) The student has acknowledged that he/she/they/them will comply with the Terms & Conditions as well as The Actors Co. rules, guidelines, policies and procedures Payment: 1. Tuition fees are to be paid in full on or before the due date(s) as set out in the enrolment forms, due week 2 from the start of term
2. If you fail to pay your tuition fees on time, the Actors Co. reserves the right to charge a late payment fee, & where it has been determined by the Actors Co. that a late payment will be accepted and paid, the student will be permitted to attend classes.
3. If you fail to pay your tuition fees on time the Actors Co. will issue two (2) notices advising you that your payment is overdue. 4. If you have not paid within seven (7) working days of the second overdue notice the Actors Co. reserves the right to:
a. Exclude you from a course or class until payment is received; b. Temporarily suspend you from all courses in which you are enrolled; c. Place restrictions or refuse future enrolment applications; d. Take legal action to recover outstanding fees and associated costs. Deposits & Payment Structures
5. All payments (eg. deposits, term fees, instalments), which are made by direct transfer into the Actors Co. bank account must be clearly identified using your surname, middle name(s), and first name(s) for identification of payment. Failure to do this may mean you are recorded in our system as failing to pay by the due date and may result in the Actors Co. imposing a late fee.
6. You are liable for payment for the fees for the whole term as a part time student and/or the whole year as a student regardless of your attendance. There are no refunds. Refunds will only be considered if you demonstrate genuine hardship (signed and approved documentation by outside bodies and relevant institutional evidentiary support will need to be provided).
7. Payments into a course, are non transferable.
8. A request to transfer a payment for a particular class time or course, to a different class time or course, can only be approved by the Actors Co. & made one (1) week prior to the commencement of the Term.
9. Any new clients enrolling in the Actors Co. are not eligible to pay by 'instalments'. Full payment for the whole term or the entire calendar year, is required from all enrolments.
10. I agree to pay for each course I select, by week 2 of the Actors Co. class commencement.
12. I understand that:
a. Late payment will mean that I will be excluded from classes until payment is received b. Failure to pay within 30 days of a course commencing will mean that I will be excluded from the Actors Co. and I will not be entitled to a refund. 13. I acknowledge I have read this enrolment form, including the terms and conditions in the registration form.
COVID Safe Settings The Actors Co. adopts special terms when there are COVIDSafe Settings in place in NSW. These special terms are informed by a safety-first approach so that classes and events are COVID safe for all students, workers, and audiences and mitigate risks of community transmission to the general public.
Enrolment Eligibility 14. Children under the age of eighteen (18) must have the written consent of their parent or guardian
15. Acting teachers from other institutions (whether private or government) are ineligible to enrol in courses conducted by The Actors Co.. To be eligible for enrolment, they must advise the Actors Co., in writing, of the following: i) Institution of Study ii) Insitution of work, past or present iii) Content & Duration of Time
16. Actors are ineligible to enrol in courses/ classes conducted by the Actors Co. unless they inform the Actors Co in writing, of the following: a) Institution(s) of study b) Scope of professional work
17. Students, parents &/or guardians agree that they have assessed the activities that make up the acting classes and warrant that they are physically and mentally capable to participate in the acting classes. Students warrant that they do not suffer any physical, mental or health condition that could be aggravated or impaired by their participation in the acting classes run by the Actors Co.
19. the Actors Co. will notify you within seven (7) days of you submitting your application form as whether or not your application has been accepted.
20. If your application is not accepted and you have paid fees, then your fees will be refunded in full.
21. The Actors Co. reserves the right to refuse entry into any of its classes, courses and shows.
Intellectual Property: 22. The rights of all works produced by the Actors Co. during and associated with the conduct of its business remain with the Actors Co., including but not limited to all material produced during face-to-face training and material recorded during online training, and/or other digital means (eg. Zoom & WhatsApp classes)
23. The rights of all works produced by students within the Actors Co. courses/classes, including assessment materials, film scripts, compositions, techniques and performances remain with the Actors Co. .
24. The Actors Co. is permitted (unless, waivered or requested by the parent or student) to use any still video, image or moving image taken by the Actors Co. or its students in any of its classes, showcases, professional commercial shoots, fund raising and social events organised by the Actors Co. for, but not limited to, the following:
a. Advertising, marketing or brochures;b. Website & media promotions. 21. If an actor or acting teacher is permitted to enrol in a course, they are not to use any materials or teaching techniques learned through their participation at the Actors Co. courses, for their own training and teaching purposes, whether through their association with another institution or in a private teaching capacity. The Actors Co. reserves all rights to protect its cirriculum & intellectual property.
22. Students (past or present) are not permitted to disclose information about The Actors Co. programs and teaching methods to other institutions or persons who conduct acting classes and/or industry competitors. Failure to comply with this clause may result in:
i. Exclusion of a student from enrolment;ii. Immediate expulsion of a student who breaches this clause;iii. Legal action by the Actors Co.. Privacy: 23. Students are required to comply with The Actors Co. Privacy Policy (accessible on The Actors Co. website or from its corporate headquarters).
24. Students are not permitted to record classes whether taught face-to-face or via online video teleconferencing platforms (Zoom or WhattsApp) or any other form of internet/video link communication. Recording includes, but is not limited to, recording using:
i) in-built facilities in the video teleconferencing platform and;ii) any other device such as a smart phone, camera, video or audio recording device. Failure to comply with this clause may result in:
a. Expulsion from the Actors Co.;b. Legal action the Actors Co. and/or third parties 25. The Actors Co. and its directors and staff will not be held liable for loss, disclosure or use of video footage and the like, which results from the actions of third parties such as other students who disregard the Actors Co. terms, conditions and policies or 'online criminal activity such as cybersecurity attacks,'
The Scheduling of Classes and Missed Classes: 26. The Actors Co. courses may be delivered face-to-face or entirely online and via email correspondence at the discretion the Actors Co.
27. The Actors Co. may change the duration and/or times of classes and/or terms with two (2) days written notice.
28. If The Actors Co. is unable to deliver a component of any of its courses, the Actors Co. reserves the right to substitute teacher replacement.
29. The Actors Co. reserves the right to cancel or terminate the whole or part of classes.
30. Public holidays are factored into an immediate catch up/alternative class, to ensure that students are not disadvantaged should one of the classes fall on a public holiday.
31. Catch-up (substitute or make up) classes will not be automatically granted if you miss your class. It is up to the Actors Co. discretion to grant a substitute class(es).
32. For beginner students, if notice for an absence from a class is granted by the Actors Co., the additional class must be taken before the end of the term. Failure to do the additional class in the current term means the loss of that additional class.
36. If a catch up class is granted and the student is not able to attend that catch up class, then they will not be entitled to another offer of a catch up class or substitite class(es). 37. A student must ensure that a correct and frequently used email is provided upon registration. If a student fails to receive important information about a class, cancellation, venue update, payment etc due to their not checking their email, this remains the sole responsibility of the student 38. Correspondance with text messages and phone calls will only be used in appropriate situations with regards to clientele, emergencies, important and significant contexts. 39. Correspondance with text messages and phone calls will only be used in appropriate situations with regards to clientele that are over 18 years of age. Attendance and Assessments 40. Students are required to actively participate in all aspects of the cirriculum and submit their work for assessment on time. Students are required to commit to putting reasonable efforts to improve their acting skillset. The Actors Co. will not be held responsible where a student’s lack of progress is as a result of their commitment, effort or lack thereof.
Gift Vouchers
41. The Actors Co. may issue you with a gift voucher to the value of the full term of a course or a yearly tuition to be redeemed. Gift Vouchers are valid for 2 years from the date of issue and are transferable. Further Covid Protocols
42. You acknowledge that anyone not adhering to these requirements may be in breach of directions issued by the Chief Health Officer for which penalties may apply.
43. Without limitation of the Terms and Conditions, you and your associates may be refused entry or required to leave our studios or venues, or event if you or they:
a. refuse to comply with any COVID-19 safety protocols or requirements notified to you by the Actors Co;
b. refuse to comply with any reasonable health and safety directions given by Venue staff;
c. are required to be in self-isolation or quarantine under applicable COVIDSafe settings.
44. We strongly recommend you and each member of your booking party make a reasonable assessment of your health status before attending our classes or events. To avoid doubt, unless required by law you will not be entitled to a refund even if you test COVID-19 positive.
45. Application of Terms and Conditions 1.1 By purchasing a ticket or other product (including merchandise) through the Actors Co. (including from the Venue, online or over the phone) or through an authorised sales channel, you agree to comply with the Terms and Conditions.
1.2 Tickets may be sold or issued by the Actors Co. in its own right or for a third party (for example, where an outside organisation is hiring an Actors Co. venue and has engaged the Actors Co. to provide ticketing services for a performance in that venue).
1.3 Where the Actors Co. sells tickets for a third party, the name of the presenter or event to which your ticket relates is usually shown on the front of the ticket but is also available from the Actors Co.. The Actors Co. has no control over, or liability for, the performance of the event. All ticketing complaints and claims, and your legal rights, are against the third-party presenter and not the Actors Co., except where the Actors Co. is at fault or where you have a legal right against the Actors Co. under the Australian Consumer Law. 46 Auditions The Actors Co. teaching faculty will only assist those students in professional and/or amateur industry auditions, who they deem, posses the requisite skills required to reflect elite industry standards. Audition assistance will not be granted to those students who lack the skillset, body of work, training, work ethic, professionalism, commitment and experience.
46.2 Amendments To Terms and Conditions 1.1 the Actors Co. may update, replace or vary these Terms and Conditions at any time, including for specific events. Changes will be made effective by posting them on the Actors Co. website.
1.2 By making a purchase through the Actors Co. or an authorised sales channel, you agree to be bound by the Terms and Conditions that apply at the time of purchase.
47. Digital Tickets 47.1 Tickets may be issued to you in digital format, including in print at home format.
47.2 If you have bought multiple tickets in print at home format, remember to print each of them out separately.
47.3 Each valid digital ticket has a unique identifier. This unique identifier allows one entry only so please ensure that each individual attending the event has their own digital ticket. Do not give a copy of your digital ticket to anyone and do not buy a digital ticket except from the Actors Co. or one of our authorised sales channels.
47.4 If there are multiple copies of a digital ticket, only the first copy to be scanned on arrival at the event will allow the ticketholder entry. Additional copies subsequently scanned will result in our system displaying the message ‘Second Entry’ (or similar) and subject to verification, entry may be denied.
47.5 Do not buy digital tickets from unauthorised sellers. If an unauthorised seller has printed multiple copies of a single ticket you may be refused entry.
48. Pricing and Payment 48.1 All prices are quoted in Australian dollars and are inclusive of GST (where applicable). Where GST applies, your ticket or invoice is a tax invoice.
48.2 Tickets or classes advertised at a particular price will be available at that price for a reasonable period of time and in reasonable quantities.
48.3 Prices are subject to change without notice.
48.4 Service fees and charges may apply to each purchase and you will be notified of the applicable fee and/or charges prior to purchase.
48.5 You warrant that you have the authority to make payment for your purchase and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to make the purchase.
48.6 If the amount paid by you for your purchase is incorrect for any reason (including invoice/ticket price and fee amount where the error was due to an error in a price posted on the Actors Co. website or otherwise communicated to you or human error or technical malfunction), the Actors Co. may cancel the order or the purchase and refund you the amount paid. Where the purchase was a ticket or invoice payment, the Actors Co. may offer you a replacement ticket or amendement of the invoice to you at the correct price.
49. Delivery and Collection of Tickets 49.1 If you purchase tickets online or by phone, you will be given a confirmation number to confirm your purchase. If you do not receive a confirmation number or are otherwise concerned that your purchase was not successful, you must contact us for confirmation of your purchase. The Actors Co. takes no responsibility for incomplete purchases including where you have not received a confirmation number but have made no attempt to confirm the order.
49.2 Delivery of tickets will only be made upon receipt of full payment. You may request digital ticket delivery (mobile or print at home) with tickets delivered via email, delivery by post (where permitted) or to collect your ticket from the Venue.
49.3 There maybe recourse if event is rescheduled and you cannot or do not wish to attend the rescheduled event.
49.4 There maybe recourse granted if event is significantly relocated, and the nature of the experience and/or geographic location of the event is fundamentally altered by the relocation.
49.5 An event is cancelled due to unforeseen circumstances that arise during the event, leaving the event uncompleted. (Note however that if a substantial proportion of the event is completed then, depending on the circumstances, the Actors Co. may determine that a refund or exchange is not warranted in which case a refund or exchange right will not apply.)
50 In the case of event reschedules and relocations, we will advise you of the cut-off date for requesting a refund. The cut-off date will be at least 3 weeks from the date we advise you of.
51 You will not be entitled to a refund or exchange in the following circumstances:
(a) Your ticket was free or complimentary.
(b) You did not enjoy the event or were dissatisfied with the performance at the event.
(c) You are unable to attend for reasons outside the Actors Co. control including but not limited to; illness; illness of any person accompanying you to the event, or other person for whom you need to care; transport failure or delay; or where you choose not to attend the event.
(d) You arrive late to an event and are refused entry on the grounds that latecomers will not be admitted, or you are delayed admission or readmission until a suitable break in the performance.
(e) You have been refused entry to or evicted from the event or Venue.
(f) A performance has been made by an understudy in the place of a main performer, provided that you have been made aware of the use of an understudy at the Event.
(g) An opening or support act is cancelled or replaced or if the acts appearing at a festival change, provided that you are made aware of the cancellation, replacement or change at the event.
(h) The advertised ticket price is changed in response to varying levels of consumer demand.
(i) Additional seats or additional dates are released for presentation of the event.
(j) Tickets for a general admission event are lost or stolen.
53 Refunds will be paid to the original ticket purchaser. Proof of identity and and/or proof of purchase (including the original ticket) may be requested.
53.1 Refunds will be processed using the original method of payment.
53.2 Refunds may not necessarily be available at the time the refund is requested.
53.3 Refunds will be limited to the face value of the ticket plus any service charges applied to the specific ticket purchase. Refunds will not include costs imposed by external suppliers that you were not obliged to incur but chose to incur, such as registered or express post fees, courier charges or insurance. Where tickets to multiple events are purchased in a single order, the Actors Co. will not refund the service charge. 53.4 Unless required by law, the Actors Co. will not reimburse you for auxiliary expenses incurred in connection with your attendance or non-attendance at an event, including a cancelled, rescheduled or relocated event. Auxiliary expenses include, but are not limited to, the cost of travel, meals, car-parking, child-care and accommodation. You may wish to take out ticket and/or travel insurance for those expenses.
54. Children’s Events and Minors 54.1 Children who have not yet turned two years old will generally be admitted into an event at no cost and without a ticket. In these cases, children will not be allocated a seat and must be seated on an accompanying adult’s lap for the duration of the event.
54.2 Some events do require children under the age of two to be admitted with a ticket - particularly for performances programmed specifically for this age group. If this is the case, this requirement will be clearly stated prior to purchase including on the event’s webpage.
55. Voluntary Assumption of Risk 55.1 You enter the Venue at your own risk.
55.2 You understand that attendance at any event and/or the Venue may carry with it certain dangers, including the risk of injury and damage to you or your property.
55.3 By attending the event and/or the Venue, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence) at the Venue. This includes damage or loss caused by the acts or omissions of other students, clients, ticketholders, visitors, guests, and the employees and agents of the Actors Co. or a presenter.
54. Limitation of Liability 54.1 To the extent permitted by law (including the Australian Consumer Law), the Actors Co. is not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the event.
54.2 Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of the Actors Co. is limited to the minimum permitted by law. 55. Refunds
Except where required by law, including the Australian Consumer Law set out in Schedule 2 of the Australian Competition & Consumer Act 2010 (ACL), the Actors Co. will only provide refunds in our absolute discretion. Any requests for a refund must be made by writing at least 14 days prior to the request.
We reserve the right to require further information or documentation to substantiate which circumstances apply before issuing a refund.

If a student fails to receive important information about a class, cancellation, venue update, payment etc due to their not checking their email, this remains the sole responsibility of the student 38. Correspondance with text messages and phone calls will only be used in appropriate situations with regards to clientele, emergencies, important and significant contexts. 39. Correspondance with text messages and phone calls will only be used in appropriate situations with regards to clientele that are over 18 years of age. Attendance and Assessments 40. Students are required to actively participate in all aspects of the cirriculum and submit their work for assessment on time. Students are required to commit to putting reasonable efforts to improve their acting skillset. The Actors Co. will not be held responsible where a student’s lack of progress is as a result of their commitment, effort or lack thereof.
Gift Vouchers
41. The Actors Co. may issue you with a gift voucher to the value of the full term of a course or a yearly tuition to be redeemed. Gift Vouchers are valid for 2 years from the date of issue and are transferable. Further Covid Protocols
42. You acknowledge that anyone not adhering to these requirements may be in breach of directions issued by the Chief Health Officer for which penalties may apply.
43. Without limitation of the Terms and Conditions, you and your associates may be refused entry or required to leave our studios or venues, or event if you or they:
a. refuse to comply with any COVID-19 safety protocols or requirements notified to you by the Actors Co;
b. refuse to comply with any reasonable health and safety directions given by Venue staff;
c. are required to be in self-isolation or quarantine under applicable COVIDSafe settings.
44. We strongly recommend you and each member of your booking party make a reasonable assessment of your health status before attending our classes or events. To avoid doubt, unless required by law you will not be entitled to a refund even if you test COVID-19 positive.
45. Application of Terms and Conditions 1.1 By purchasing a ticket or other product (including merchandise) through the Actors Co. (including from the Venue, online or over the phone) or through an authorised sales channel, you agree to comply with the Terms and Conditions.
1.2 Tickets may be sold or issued by the Actors Co. in its own right or for a third party (for example, where an outside organisation is hiring an Actors Co. venue and has engaged the Actors Co. to provide ticketing services for a performance in that venue).
1.3 Where the Actors Co. sells tickets for a third party, the name of the presenter or event to which your ticket relates is usually shown on the front of the ticket but is also available from the Actors Co.. The Actors Co. has no control over, or liability for, the performance of the event. All ticketing complaints and claims, and your legal rights, are against the third-party presenter and not the Actors Co., except where the Actors Co. is at fault or where you have a legal right against the Actors Co. under the Australian Consumer Law. 46 Auditions The Actors Co. teaching faculty will only assist those students in professional and/or amateur industry auditions, who they deem, posses the requisite skills required to reflect elite industry standards. Audition assistance will not be granted to those students who lack the skillset, body of work, training, work ethic, professionalism, commitment and experience.
46.2 Amendments To Terms and Conditions 1.1 the Actors Co. may update, replace or vary these Terms and Conditions at any time, including for specific events. Changes will be made effective by posting them on the Actors Co. website.
1.2 By making a purchase through the Actors Co. or an authorised sales channel, you agree to be bound by the Terms and Conditions that apply at the time of purchase.
47. Digital Tickets 47.1 Tickets may be issued to you in digital format, including in print at home format.
47.2 If you have bought multiple tickets in print at home format, remember to print each of them out separately.
47.3 Each valid digital ticket has a unique identifier. This unique identifier allows one entry only so please ensure that each individual attending the event has their own digital ticket. Do not give a copy of your digital ticket to anyone and do not buy a digital ticket except from the Actors Co. or one of our authorised sales channels.
47.4 If there are multiple copies of a digital ticket, only the first copy to be scanned on arrival at the event will allow the ticketholder entry. Additional copies subsequently scanned will result in our system displaying the message ‘Second Entry’ (or similar) and subject to verification, entry may be denied.
47.5 Do not buy digital tickets from unauthorised sellers. If an unauthorised seller has printed multiple copies of a single ticket you may be refused entry.
48. Pricing and Payment 48.1 All prices are quoted in Australian dollars and are inclusive of GST (where applicable). Where GST applies, your ticket or invoice is a tax invoice.
48.2 Tickets or classes advertised at a particular price will be available at that price for a reasonable period of time and in reasonable quantities.
48.3 Prices are subject to change without notice.
48.4 Service fees and charges may apply to each purchase and you will be notified of the applicable fee and/or charges prior to purchase.
48.5 You warrant that you have the authority to make payment for your purchase and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to make the purchase.
48.6 If the amount paid by you for your purchase is incorrect for any reason (including invoice/ticket price and fee amount where the error was due to an error in a price posted on the Actors Co. website or otherwise communicated to you or human error or technical malfunction), the Actors Co. may cancel the order or the purchase and refund you the amount paid. Where the purchase was a ticket or invoice payment, the Actors Co. may offer you a replacement ticket or amendement of the invoice to you at the correct price.
49. Delivery and Collection of Tickets 49.1 If you purchase tickets online or by phone, you will be given a confirmation number to confirm your purchase. If you do not receive a confirmation number or are otherwise concerned that your purchase was not successful, you must contact us for confirmation of your purchase. The Actors Co. takes no responsibility for incomplete purchases including where you have not received a confirmation number but have made no attempt to confirm the order.
49.2 Delivery of tickets will only be made upon receipt of full payment. You may request digital ticket delivery (mobile or print at home) with tickets delivered via email, delivery by post (where permitted) or to collect your ticket from the Venue.
49.3 There maybe recourse if event is rescheduled and you cannot or do not wish to attend the rescheduled event.
49.4 There maybe recourse granted if event is significantly relocated, and the nature of the experience and/or geographic location of the event is fundamentally altered by the relocation.
49.5 An event is cancelled due to unforeseen circumstances that arise during the event, leaving the event uncompleted. (Note however that if a substantial proportion of the event is completed then, depending on the circumstances, the Actors Co. may determine that a refund or exchange is not warranted in which case a refund or exchange right will not apply.)
50 In the case of event reschedules and relocations, we will advise you of the cut-off date for requesting a refund. The cut-off date will be at least 3 weeks from the date we advise you of.
51 You will not be entitled to a refund or exchange in the following circumstances:
(a) Your ticket was free or complimentary.
(b) You did not enjoy the event or were dissatisfied with the performance at the event.
(c) You are unable to attend for reasons outside the Actors Co. control including but not limited to; illness; illness of any person accompanying you to the event, or other person for whom you need to care; transport failure or delay; or where you choose not to attend the event.
(d) You arrive late to an event and are refused entry on the grounds that latecomers will not be admitted, or you are delayed admission or readmission until a suitable break in the performance.
(e) You have been refused entry to or evicted from the event or Venue.
(f) A performance has been made by an understudy in the place of a main performer, provided that you have been made aware of the use of an understudy at the Event.
(g) An opening or support act is cancelled or replaced or if the acts appearing at a festival change, provided that you are made aware of the cancellation, replacement or change at the event.
(h) The advertised ticket price is changed in response to varying levels of consumer demand.
(i) Additional seats or additional dates are released for presentation of the event.
(j) Tickets for a general admission event are lost or stolen.
53 Refunds will be paid to the original ticket purchaser. Proof of identity and and/or proof of purchase (including the original ticket) may be requested.
53.1 Refunds will be processed using the original method of payment.
53.2 Refunds may not necessarily be available at the time the refund is requested.
53.3 Refunds will be limited to the face value of the ticket plus any service charges applied to the specific ticket purchase. Refunds will not include costs imposed by external suppliers that you were not obliged to incur but chose to incur, such as registered or express post fees, courier charges or insurance. Where tickets to multiple events are purchased in a single order, the Actors Co. will not refund the service charge. 53.4 Unless required by law, the Actors Co. will not reimburse you for auxiliary expenses incurred in connection with your attendance or non-attendance at an event, including a cancelled, rescheduled or relocated event. Auxiliary expenses include, but are not limited to, the cost of travel, meals, car-parking, child-care and accommodation. You may wish to take out ticket and/or travel insurance for those expenses.
54. Children’s Events and Minors 54.1 Children who have not yet turned two years old will generally be admitted into an event at no cost and without a ticket. In these cases, children will not be allocated a seat and must be seated on an accompanying adult’s lap for the duration of the event.
54.2 Some events do require children under the age of two to be admitted with a ticket - particularly for performances programmed specifically for this age group. If this is the case, this requirement will be clearly stated prior to purchase including on the event’s webpage.
55. Voluntary Assumption of Risk 55.1 You enter the Venue at your own risk.
55.2 You understand that attendance at any event and/or the Venue may carry with it certain dangers, including the risk of injury and damage to you or your property.
55.3 By attending the event and/or the Venue, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence) at the Venue. This includes damage or loss caused by the acts or omissions of other students, clients, ticketholders, visitors, guests, and the employees and agents of the Actors Co. or a presenter.
54. Limitation of Liability 54.1 To the extent permitted by law (including the Australian Consumer Law), the Actors Co. is not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at the Venue and/or the event.
54.2 Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of the Actors Co. is limited to the minimum permitted by law. 55. Refunds
Except where required by law, including the Australian Consumer Law set out in Schedule 2 of the Australian Competition & Consumer Act 2010 (ACL), the Actors Co. will only provide refunds in our absolute discretion. Any requests for a refund must be made by writing at least 14 days prior to the request.
We reserve the right to require further information or documentation to substantiate which circumstances apply before issuing a refund.
